Agreement between the Kingdom of Belgium and the Republic of Cyprus on commercial scheduled air transport The Kingdom of Belgium and the Republic of Cyprus, hereinafter called in the present Agreement the Contracting Parties, both being parties to the Convention on Internaitonal Civil Aviation opened for signature at Chicago, on the 7th day of December 1944, hereinafter referred to in the present Agreement as the « Convention » and desiring to make arrangements of commercial scheduled air transport between and beyond their respective territories particularly with a view to promoting tourism, have agreed on the following : Article 1.

For the purpose of the present Agreement and the Annex thereto the following terms have the following meaning, unless otherwise stated in the next : (a) « Aeronautical Authorities » means in the case of the Kingdom of Belgium, the Administration of Aeronatics of the Ministry of Communications and in the case of the Republic of Cyprus the Civil Aviation Administration of the Ministry of Communications and Works or in both cases any other agency or person authorized to perform the functions presently exercised by the said Authorities.(b) « Designated Airline » means the airline that one of the Contracting Parties shall have designated in writing to the other Contracting Party in accordance with Article 3 of this Agreement as the airline which is to operate the international air services on the routes specified in Article 2 para.1 of the present Agreement. (c) « Territory » « air services » « international air services » and « stop for non-traffic purposes » shall have, in the application of the present Agreement the meaning specified in Articles 2 and 96 of the Convention. Article 2. (1) Each Contracting Party grants to the other Contracting Party the rights specified in the present Agreement for the purpose of establishing scheduled international air services on the routes specified in the Annex to this Agreement. Such services and routes are hereinafter called « the agreed services » and « the specified routes » respectively.

The airline designated by each Contracting Party shall enjoy while operating an agreed service on a specified route, the following rights : (a) To fly across the territory of the other Contracting Party;(b) To make stops in the said territory for non-traffic purposes;(c) To make stops in the said territory at the points specified for that route in the Annex to the present Agreement for the purpose of putting down and taking on International traffic in passengers, cargo and mail.(2) Nothing in paragraph (1) of this Article shall be deemed to confer on the airline of one Contracting Party the privilege of taking up, in the territory of the other Contracting Party, passengers cargo, or mail, carried for remuneration or hire and destined for another point in the territory of that other Contracting Party. Article 3. (1) Each Contracting Party shall have the right to designate in writing to the other Contracting Party one airline for the purpose of operating the agreed services on the specified routes.(2) On receipt of such designation, the other Contracting Party shall, subject to the provisions of paragraphs (3) and (4) of this Article, without delay grant to the designated airline the appropriate operating authorization.(3) The Aeronautical Authorities of one Contracting Party may require the airline designated by the other Contracting Party to satisfy them that it is qualified to fulfil the conditions prescribed under the laws and regulations normally and reasonably applied to the operation of international air services by such authorities in conformity with the provisions of the Convention.(4) Each Contracting Party shall have the right to refuse to grant the operating authorization referred to in paragraph (2) of this article, or to impose such conditions as it may deem necessary on the exercise by a designated airline of the rights specified in Article 2, in any case where the said Contracting Party is not satisfied that substantial ownership and effective control of that airline are vested in the Contracting Party designating the airline or in its nationals.(5) When a airline has been so designated and authorized, it may begin at any time to operate the agreed services, provided that a tariff established in accordance with the provisions of Article 10 of the present Agreement is in force in respect of that service. Article 4. (1) There shall be fair and equal opportunity for the designated airline of each Contracting Party to operate on any route specified in accordance with Article 2 of the present Agreement.(2) In the operation of international air services on the routes specified in accordance with Article 2 of the present Agreement the designated airline of one Contracting Party shall take account the intrests of the designated airline of the other Contracting Party so as not to affect unduly the air services which the latter airline provides on the same routes or parts of them.(3) The international air services on the routes specified in accordance with Article 2 of the present Agreement shall have as their primary objective the provision of capacity adequate to the foreseeable traffic demands to and from the territory of the Contracting Party designatting the airline.The right of either designated airline to carry traffic between points in the territory of the other Contracting Party and points on the territory of third countries on the specified routes in accordance with Article 2 of the present Agreement, shall be exercised in the interests of an orderly development of international air transport in such a way that capacity is related to : (a) the traffic demand to and from the territory of the Contracting Party designating the airline.(b) the traffic demand existing in the areas through which the air services pass, taking account of local and regional services.(c) the requirements of an economical operation of through services. Article 5 (1) The designated airline of each Contracting Party shall communicate for approval to the Aeronautical Authorities of the other Contracting Party not later than thirty days prior to the commencement of services on the routes specified in accordance with Article 2 of the present Agreement the types of aircraft to be used and the flight schedules. They will be considered as approved if a reply from the aeronautical Authorities concerned is not given within a period of three weeks from the day of receipt.

This shall likewise apply to later changes. (2) The Aeronautical Authorities of one Contracting Party shall furnish the Aeronautical Authorities of the other Contracting Party, at their request, with all periodic statistical data of the designated airlines, as may be reasonably required for the purpose of reviewing the capacity provided by the designated airline of the first Contracting Party on the routes specified in accordance with Article 2 of the present Agreement.Such data shall include all information required to determine the amount of traffic and the origin and destination of such traffic. These statistics will not exceed what is currently required by the Council of I.C.A.O. Article 6. (1) Each Contracting Party shall have the right to revoke an operating authorization or to suspend the exercise of the rights specified in Article 2 of the present Agreement by the airline designated by the other Contracting Party, or to impose such conditions as it may deem necessary on the exercise of these rights : (a) in any case where it is not satisfied that substantial ownership and effective control of that airline are vested in the Contracting Party designating the airline or in nationals of such Contracting Party, or (b) in the case of failure by that airline to comply with the laws or regulations of the Contracting Party granting these rights, or (c) in case the airline otherwise fails to operate in accordance with the conditions prescribed under the present Agreement.(2) Unless immediate revocation, suspension and imposition of the conditions mentioned in paragraph (1) of this Article is essential to prevent further infringements of laws or regulations, such right shall be exercised only after consultation with the other Contracting Party. Article 7. (1) Aircraft operated on international services by the designated airline of either Contracting Party, as well as their regular equipment, supplies of fuels and lubricants, and aircraft stores (including food, beverages and tobacco) on board such aircraft shall be exempt from all customs duties, inspection fees and other duties or taxes on arriving in the territory of the other Contracting Party, provided such equipment and supplies shall remain on board the aircraft up to such time as they are re-exported.(2) There shall also be exempt from the same duties and taxes, with the exception of charges corresponding to the service performed : (a) aircraft stores taken on board in the territory of either Contracting Party, within limits fixed by the authorities of said Contracting Party, and for use on board aircraft engaged on a specified route of the other Contracting Party;(b) spare parts entered into the territory of either Contracting Party for the maintenance or repair of aircraft used on a specified route by the designated airline of the other Contracting Party;(c) fuel and lubricants destined for supply to aircraft operated on a specified route by the designated airlines of the other Contracting Party, even when these supplies are to be used on the part of the journey performed over the territory of the Contracting Party in which they are taken on board. Materials referred to in sub-paragraphs (a), (b) and (c) above may be required to be kept under customs supervision or control.

Article 8.

The regular airborne equipment, as well as the materials and supplies retained on board the aircraft of either Contracting Party may be unloaded in the territory of the other Contracting Party only with the approval of the customs authorities of such territory. In such case, the may be placed under the supervision of said authorities up to such time as they are re-exported or otherwise disposed of in accordance with Customs regulations.

Article 9.

Passengers in transit across the territory of either Contracting Party shall be subject to no more than a very simplified control. Baggage and cargo in direct transit shall be exempt from customs duties and other similar taxes.

Article 10. (1) The tariffs to be charged by the airline of one Contracting Party for carriage to or from the territory of the other Contracting Party shall be established at reasonable levels due regard being paid to all relevant factors including cost of operation, reasonable profit and the tariffs of other airlines.(2) The tariffs referred to in paragraph (1) of this Article shall, if possible, be agreed by the designated airlines concerned of both Contracting Parties, in consultation with other airlines operating over the whole or part of the route, and such agreement shall, where possible, be reached through the rate-fixing machinery of the International Air Transport Association.(3) The tariffs so agreed shall be submitted for approval to the aeronautical authorities of the Contracting Parties at least thirty (30) days before the proposed date of their introduction;in special cases, this time limit may be reduced, subject to the Agreement of the said authorities. (4) If the designated airlines cannot agree on any of these tariffs, or if for some other reason a tariff cannot be fixed in accordance with the provisions of paragraph (2) of the Article, or if during the first 15 days of the 30 days' period referred to in paragraph (3) of this Article one Contracting Party gives the other Contracting Party notice of its dissatisfaction with any tariff agreed in accordance with the provisions of paragraph (2) of this Article, the aeronautical authorities of the Contracting Parties shall try to determine the tariff by agreement between themselves.(5) If the aeronautical authorities cannot agree on the approval of any tariff submitted to them under paragraph (3) of this Article or on the determination of any tariff under paragraph (4), the dispute shall be settled in accordance with the provisions of Article 15 of het present Agreement.(6) Subject to the provisions of paragraph (3) of this Article, no tariff shall come into force if the aeronautical authorities of either Contracting Party have not approved it.(7) The tariffs established in accordance with the provisions of this Article shall remain in force until new tariffs have been established in accordance with the provisions of this Article. Article 11.

In a spirit of close co-operation, the Aeronautical Authorities of the Contracting Parties shall consult each other form time to time with a view to ensuring the implementation of, and satisfactory compliance with, the provisions of the present Agreement and the Annex thereto.

Article 12. (1) If either of the Contracting Parties considers it desirable to modifiy any provisions of the present Agreement, it may request consultation with the other Contracting Party.Such consultation, which may be between Aeronautical Authorities and which may be through discussion or by correspondence, shall begin within a period of sixty (60) days of the date of the request.Any modifications so agreed shall come into force when they have been confirmed by an exchange of diplomatic notes. (2) Modifications to the Annex of this Agreement may be made by direct agreement between the competent Aeronautical Authorities of the Contracting Parties and shall come into force upon exchange of notes through diplomatic channels. Article 13.

The present Agreement and the Annex to this Agreement will be amended so as to conform with any multilateral convention which may become binding on both Contracting Parties.

Article 14.

Either Contracting Party may at any time give notice to the other Contracting Party of its decision to terminate the present Agreement; such notice shall be simultaneously communicated to the International Civil Aviation Organization. In such case the Agreement shall terminate twelve (12) months after the date of receipt of the notice by the other Contracting Party, unless the notice to terminate is withdrawn by agreement before the expiry of this period. In the absence of acknowledgement of receipt by the other Contracting Party, notice shall be deemed to have been received fourteen (14) days after the receipt of the notice by the International Civil Aviation Organization.

Article 15. (1) If any dispute arises between the Contracting Parties relating to the interpretation or application of the present Agreement, the Contracting Parties shall in the first place endeavour to settle it by negotiations.(2) If the Contracting Parties fail to reach a settlement by negotiation, they may agree to refer the dispute for decision to some person or body or the dispute may at the request of either Contracting Party be submitted for decision to a tribunal of three Arbitrators, one to be nominated by each Contracting Party and the third to be appointed by the two so nominated arbitrators.Each of the Contracting Parties shall nominate an arbitrator within a period of sixty days from the date of receipt by either Contracting Party from the other of a notice through diplomatic channels requesting arbitration of the dispute and the third arbitrator shall be appointed within a further period of sixty days. If either of the Contracting Parties fails to nominate an arbitrator within the period specified, or if the third arbitrator is not appointed within the period specified the President of the Council of the International Civil Aviation Organization may be requested by either Contracting Party to appoint an arbitrator or arbitrators as the case requires. In such case, the third arbitrator shall be a national of a third State and shall act as president of the arbitral body. (3) The Contracting Parties undertake to comply with any decision given under paragraph (2) of this Article.(4) The expenses of the arbitration will be equally shared between the Contracting Parties. Article 16.

The charges imposed by either Contracting Party for the use of airports and other aviation facilities by the aircraft of the designated airline of the other Contracting Party shall not be higher than those paid by its national aircraft operating international services.

Article 17.

The present Agreement, any amendment to it and any exchange of notes under this Agreement shall be communicated to the international Civil Aviation Organization for registration.

Article 18.

The present Agreement, shall supersede and cancel any previous agreement on international air services concerning air services between the Contracting Parties.

Article 19. (1) The present Agreement shall enter into force from the date of the receipt by the Government of the Kingdom of Beglium of official notification of its publication in the official Gazette of the Republic of Cyprus.(2) The Government of the Kingdom of Belgium shall inform the Government of the Republic of Cyprus of the ratification of the present Agreement by the Kingdom of Belgium and the Government of the of the Republic of Cyprus shall deem this agreement as finalised from the date of such notification.(3) In witness whereof, the undersigned, being duly authorised by their respective Governments, have signed this Agreement. Done, in duplicate, at Nicosia this 8th day of June 1963 in the English language.

ANNEX (1) I. Routes to be operated by the designated airline of Cyprus in both directions:- Nicosia to Brussels via Istanbul and/or a point in Yugoslavia and/or Vienna and/or a point in the Federal Republic of Germany and/or a point in Switzerland and beyond a) to London and/or Amsterdam and/or Stockholm and/or New York.b) to Manchester and/or Glasgow. The designated airline of Cyprus may on any or all flights omit calling at any of the above points provided that the agreed services on the route begin at Nicosia.

The designated airline of Cyprus may on any or all flights call at points not mentioned above. In such a case, it shall not put down or take on traffic in passengers, cargo and mail originating at such points and destined for Brussels or vice versa.

II Routes to be operated by the designated airline of Belgium in both directions:- Brussels to Nicosia via Vienna and beyond a) to points in Iran, Afghanistan, Karachi, Bombay, Colombo, Bangkok, Kuala Lumpur, Singapore, Djakarta, Manilla, point in China, Tokyo b) to Entebbe, Dar-Es-Salaam, Kigali, Bujumbura, point in Zaire, Lusaka, Johannesburg. The designated airline of Belgium may on any or all flights omit calling at any of the above points provided that the agreed services on the route begin at Brussels.

In such a case, it shall not put down or take on traffic in passengers, cargo and mail originating at such points and destined for Nicosia or vice versa. _______ Nota (1) Schedule as revised by the Agreement concluded by exchange of notes signed at Beirut and Nicosia on 30 April and 18 July 1974, modifying the Annex to the Agreement between the Kingdom of Belgium and the Republic of Cyprus on commercial scheduled air transport, done at Nicosia on 8 June 1963. TRADUCTION Accord entre le Royaume de Belgique et la République de Chypre relatif aux transports aériens commerciaux réguliers (1) Le Royaume de Belgique et la République de Chypre, dénommés ci-après, dans le présent Accord, les « Parties contractantes », Etant tous deux Parties à la Convention relative à l'Aviation civile internationale, ouverte à la signature à Chicago, le 7 décembre 1944, dénommée ci-après, dans le présent Accord, la « Convention », et désirant organiser des transports aériens commerciaux réguliers entre leurs territoires respectifs et au-delà, notamment en vue de favoriser le tourisme, Sont convenus de ce qui suit : Article 1er Aux fins du présent Accord et de son Annexe, les expressions et le terme ci-après ont la signification suivante, sauf dispositions contraires dans le texte : (a) L'expression « Autorités aéronautiques » signifie, dans le cas du Royaume de Belgique, le Ministère des Communications, Administration de l'Aéronautique, et, dans le cas de la République de Chypre, le Ministère des Communications et des Travaux publics, Administration de l'Aviation civile, ou, dans les deux cas, tout autre organise ou toute autre personne autorisés à remplir les fonctions exercées actuellement par lesdites Autorités.(b) L'expression « Entreprise désignée » signifie l'entreprise de transport aérien que l'une des Parties contractantes aura désignée par une notification écrite à l'autre Partie contractante, conformément à l'article 3 du présent Accord, comme étant l'entreprise qui doit assurer l'exploitation des services aériens internationaux sur les routes spécifiées à l'article 2, paragraphe 1er, du présent Accord.(c) Le terme « Territoire », les expressions : « Services aériens », « Services aériens internationaux » et « Escale à des fins non-commerciales » auront, dans l'application du présent Accord, la signification spécifiée aux articles 2 et 96 de la Convention. Article 2 1. Chaque Partie contractante accorde à l'autre Partie contractante les droits spécifiés dans le présent Accord en vue d'établir des services aériens internationaux réguliers sur les routes spécifiées dans l'Annexe au présent Accord. Ces services et ces routes sont dénommés ci-après respectivement « les Services convenus » et « les routes spécifiées ».

L'entreprise désignée par chacune des Parties contractantes jouira, lorsqu'elle exploitera un service convenu sur une route spécifiée, des droits suivants : (a) survoler le territoire de l'autre Partie contractante;(b) faire escale sur ledit territoire pour des fins non-commerciales;(c) faire escale sur ledit territoire, aux points spécifiés, sur cette route, dans l'Annexe au présent Accord, afin de débarquer et d'embarquer, en trafic international, des passagers, des marchandises et du courrier. Aucune disposition du paragraphe (1) du présent article ne sera interprétée comme accordant à l'entreprise de transport aérien de l'une des Parties contractantes, le droit d'embarquer, contre rémunération ou en exécution d'un contrat de location, sur le territoire de l'autre Partie contractante, des passagers, des marchandises ou du courrier à destination d'un autre point du territoire de cette autre Partie contractante.

Article 3 1. Chaque Partie contractante aura le droit de désigner par notification écrite à l'autre Partie contractante une entreprise de transport aérien afin d'exploiter les services convenus sur les routes spécifiées.2. A la réception de cette désignation, l'autre Partie contractante devra, sous réserve des dispositions des paragraphes (3) et (4) du Présent article, accorder, sans délai, à l'entreprise de transport aérien désignée, l'autorisation d'exploitation appropriée.3. Les Autorités aéronautiques de l'une des Parties contractantes pourront exiger que l'entreprise de transport aérien désignée par l'autre Partie contractante fasse la preuve qu'elle est à même de satisfaire aux conditions prescrites par les lois et règlements normalement et raisonnablement appliqués par lesdites Autorités à l'exploitation des services aériens internationaux, conformément aux dispositions de la Convention.4. Chaque Partie contractante aura le droit de ne pas accorder l'autorisation d'exploitation prévue au paragraphe (2) du présent article, ou de subordonner aux conditions qu'elle jugera nécessaires l'exercice, par une entreprise de transport aérien désignée, des droits spécifiés à l'article 2, lorsque ladite Partie contractante n'est pas convaincue qu'une part substantielle de la propriété et la direction effective de cette entreprise appartiennent à la Partie contractante qui a désigné l'entreprise ou à des ressortissants de celle-ci. Lorsqu'une entreprise de transports aériens aura été désignée et autorisée, elle pourra commencer à tout moment l'exploitation des services convenus, à condition qu'un tarif établi conformément aux dispositions de l'article 10 du présent Accord soit appliqué pour ces services.

Article 4 1. L'entreprise désignée de chaque Partie contractante jouira d'un traitement juste et égal dans l'exploitation de toute route spécifiée conformément à l'article 2 du présent Accord.2. En exploitant les services aériens internationaux sur les routes spécifiées conformément à l'article 2 du présent Accord, l'entreprise désignée d'une Partie contractante tiendra compte des intérêts de l'entreprise désignée de l'autre Partie contractante, afin de ne pas nuire indûment aux services aériens que cette dernière entreprise assure sur tout ou partie des mêmes routes.3. Les services aériens internationaux sur les routes spécifiées conformément à l'article 2 du présent Accord auront pour but principal d'assurer une capacité suffisant aux besoins prévisibles en transport aérien en provenance et à destination du territoire de la Partie contractante qui a désigné l'entreprise de transport aérien.Le droit de chaque entreprise désignée d'assurer les transports aériens entre des points situés sur le territoire de l'autre Partie contractante et des points situés sur le territoire de pays tiers, sur les routes spécifiées conformément à l'article 2 du présent Accord, sera exercé dans l'intérêt d'un développement harmonieux des transports aériens internationaux de telle façon que la capacité soit en rapport avec : (a) les besoins en transport aérien à destination et en provenance du territoire de la Partie contractante qui a désigné l'entreprise de transport aérien;(b) les besoins en transport aérien existant dans les régions desservies par les services aériens, compte tenu des services locaux et régionaux;(c) les exigences d'une exploitation économique des services long courrier. Article 5 1. L'entreprise désignée de chaque Partie contractante communiquera pour approbation aux Autorités aéronautiques de l'autre Partie contractante, trente jours au plus tard avant le début de l'exploitation des services sur les routes spécifiées conformément à l'article 2 du présent Accord les types d'aéronefs utilisés et les horaires de vol.L'approbation sera considérée comme acquise si les Autorités aéronautiques compétentes n'ont pas donné de réponse dans les trois semaines à dater de la réception de la notification.

Le même règle s'appliquera aux changements ultérieurs. 2. Les Autorités aéronautiques de l'une des Parties contractantes fourniront aux Autorités aéronautiques de l'autre Partie contractante, à leur demande, toutes les données statistiques périodiques des entreprises désignées, dont elles peuvent avoir normalement besoin pour juger de la capacité fournie par l'entreprise désignée de la première Partie contractante sur les routes spécifiées conformément à l'article 2 du présent Accord.Ces données statistiques contiendront tous les renseignements nécessaires pour déterminer le volume, la provenance et la destination du trafic.

Ces statistiques n'excéderont pas ce qui est couramment requis par le Conseil de l'Organisation de l'Aviation civile internationale.

Article 6 1. Chaque Partie contractante aura le droit de révoquer une autorisation d'exploitation ou de suspendre l'exercice des droits spécifiés à l'article 2 du présent Accord par l'entreprise désignée par l'autre Partie contractante, ou de subordonner aux conditions qu'elle jugera nécessaires l'exercice de ces droits lorsque : (a) elle ne sera pas convaincue qu'une part substantielle de la propriété et la direction effective de cette entreprise appartiennent à la Partie contractante qui a désigné l'entreprise ou à des ressortissants de celle-ci, ou que (b) cette entreprise ne se sera pas conformée aux lois et règlements de la Partie contractante qui a accordé ces droits, ou que (c) dans l'exploitation des services, cette entreprise enfreint de toute autre manière les conditions énoncées dans le présent Accord.2. A moins qu'il ne soit indispensable de recourir immédiatement à la révocation, à la suspension ou à l'imposition de conditions comme prévu au paragraphe (1) du présent article pour éviter de nouvelles infractions aux lois et règlements, un tel droit ne pourra être exercé qu'après consultation de l'autre Partie contractante. Article 7 1. Les aéronefs utilisés en trafic international par l'entreprise désignée d'une Partie contractante ainsi que leurs équipements normaux, leurs réserves de carburants et lubrifiants, leurs provisions de bord (y compris les denrées alimentaires, les boissons et tabacs) qui se trouvent à bord de ces aéronefs seront, à l'entrée sur le territoire de l'autre Partie contractante, exonérés de tous droits de douane, frais d'inspection et autres droits ou taxes, à condition que ces équipements et approvisionnements demeurent à bord des aéronefs jusqu'à leur réexportation.2. Seront également exonérés de ces mêmes droits ou taxes à l'exception des redevances représentatives de services rendus : (a) les provisions embarquées sur le territoire d'une Partie contractante dans les limites fixées par les Autorités de ladite Partie contractante et destinées à être utilisées à bord d'un service sur une route spécifiée de l'autre Partie contractante;(b) les pièces de rechange importées sur le territoire de l'une des Parties contractantes pour l'entretien ou la réparation des aéronefs exploités sur une route spécifiée par l'entreprise désignée de l'autre Partie contractante;(c) les carburants et lubrifiants destinés à l'avitaillement des aéronefs exploités sur une route spécifiée par les entreprises désignées de l'autre Partie contractante même lorsque ces approvisionnements doivent être utilisés sur la partie du trajet effectuée au-dessus du territoire de la Partie contractante sur lequel ils ont été embarqués. Les matériels et approvisionnements visés aux litteras (a), (b) et (c) ci-dessus pourront être placés sous la surveillance ou le contrôle de la douane.

Article 8 Les équipements normaux de bord, ainsi que les matériels et approvisionnements se trouvant à bord des aéronefs d'une Partie contractante ne pourront être déchargés sur le territoire de l'autre Partie contractante qu'avec le consentement des Autorités douanières de ce territoire. En ce cas, ils pourront être placés sous la surveillance desdites Autorités jusqu'à ce qu'ils soient réexportés ou qu'ils aient reçu une autre destination conformément aux règlements douaniers.

Article 9 Les passagers en transit à travers le territoire d'une Partie contractante ne seront soumis qu'à un contrôle très simplifié. Les bagages et le fret en transit direct seront exonérés des droits de douane et autres taxes similaires.

Article 10 1. Les tarifs appliqués par l'entreprise de transport aérien de l'une des Parties contractantes pour les transports à destination ou en provenance du territoire de l'autre Partie contractante seront fixés à des taux raisonnables, compte tenu de tous les éléments d'appréciation, notamment des frais d'exploitation, d'un bénéfice raisonnable, ainsi que des tarifs des autres entreprises de transport aérien.2. Les tarifs auxquels le paragraphe (1) du présent article se réfère seront, si possible, établis d'un commun accord par les entreprises désignées intéressées des deux Parties contractantes et après consultation des autres entreprises qui desservent la route en tout ou en partie.Dans la mesure du possible, cet accord se fera selon la procédure de fixation des tarifs établie par l'Association du Transport aérien international. 3. Les tarifs ainsi fixés devront être soumis à l'approbation des Autorités aéronautiques des Parties contractantes au minimum trente (30) jours avant la date prévue pour leur entrée en vigueur, ce délai pouvant être réduit dans les cas spéciaux, sous réserve de l'accord de ces Autorités.4. Si les entreprises désignées ne parviennent pas à convenir de la fixation d'un tarif ou si pour quelque autre raison, un tarif ne peut être établi conformément aux dispositions du paragraphe (2) du présent article, ou si pendant les quinze premiers jours de la période de 30 jours visée au paragraphe (3) du présent article, l'une des Parties contractantes fait connaître son désaccord sur le tarif qui lui a été soumis, conformément aux dispositions du paragraphe (2) du présent article, les Autorités aéronautiques des Parties contractantes s'efforceront de fixer le tarif de commun accord.5. Si les Autorités aéronautiques ne peuvent approuver un tarif qui leur est proposé conformément au paragraphe (3) du présent article ou ne peuvent fixer un tarif conformément aux dispositions du paragraphe (4), le différend sera réglé conformément aux dispositions de l'article 15 du présent Accord.6. Sous réserve des dispositions du paragraphe (3) du présent article, aucun tarif n'entrera en vigueur si les Autorités aéronautiques d'une Partie contractante ne l'ont pas approuvé.7. Les tarifs établis conformément aux dispositions du présent article resteront en vigueur jusqu'à ce que de nouveaux tarifs aient été fixés conformément aux dispositions du présent article. Article 11 Dans un esprit d'étroite collaboration, les Autorités aéronautiques des Parties contractantes se consulteront périodiquement en vue d'assurer l'application et l'exécution satisfaisantes des dispositions du présent Accord et de son Annexe.

Article 12 1. Si une Partie contractante juge souhaitable de modifier certaines dispositions du présent Accord, elle pourra demander des consultations avec l'autre Partie contractante.De telles consultations, qui pourront se tenir entre les Autorités aéronautiques, par voie de discussions ou par correspondance, commenceront dans les soixante (60) jours de la date de la demande. Toute modification du présent Accord convenue suite à telles consultations, entrera en vigueur lorsqu'elle aura été confirmée par un échange de notes diplomatiques. 2. L'Annexe au présent Accord pourra être modifiée par voie d'accord direct entre les Autorités aéronautiques compétentes des Parties contractantes;les modifications entreront en vigueur lors de l'échange de notes par voie diplomatique.

Article 13 Le présent Accord et l'Annexe au présent Accord seront modifiés de façon à être conformes avec toute convention multilatérale qui viendrait à lier les deux Parties contractantes.

Article 14 Chacune des Parties contractantes pourra à tout moment notifier à l'autre Partie contractante sa décision de mettre fin au présent Accord; elle en avisera simultanément l'Organisation de l'Aviation civile internationale. En ce cas, le présent Accord prendra fin douze (12) mois après la date de la réception de la notification par l'autre Partie contractante à moins que d'un commun accord l'avis de résiliation ne soit retiré avant l'expiration de cette période.En l'absence d'un accusé de réception de la part de l'autre Partie contractante, la notification sera tenue pour reçue quatorze (14) jours après sa réception par l'Organisation de l'Aviation civile internationale.

Article 15 1. Si un différend surgit entre les Parties contractantes au sujet de l'interprétation ou de l'application du présent Accord, les Parties contractantes s'efforceront d'abord de le régler par voie de négociations.2. Si les Parties contractantes ne parviennent pas à s'entendre après négociations, elles pourront soumettre le différend à la décision d'une personne ou d'un organisme;le différend pourra également être soumis, sur demande d'une des Parties contractantes, à la décision d'un tribunal composé de trois arbitres, chaque Partie contractante nommant un arbitre et le troisième étant désigné par les deux arbitres ainsi nommés. Chacune des Parties contractantes désignera un arbitre dans les soixante jours de la date de réception par l'une des Parties contractantes d'une notification par voie diplomatique de l'autre Partie contractante demandant l'arbitrage du différend, et le troisième arbitre sera désigné dans un nouveau délai de soixante jours.

Si une Partie contractante n'a pas désigné un arbitre dans le délai indiqué ou si le troisième arbitre n'a pas été désigné dans le délai indiquée, l'une ou l'autre des Parties contractantes pourra inviter le Président du Conseil de l'Organisation de l'Aviation civile internationale à désigner un ou des arbitres, selon le cas.

En ce cas, le troisième arbitre sera un ressortissant d'un Etat tiers et fera fonction de président du tribunal d'arbitrage. 3. Les Parties contractantes s'engagent à se soumettre à toute décision rendue conformément au paragraphe (2) du présent article.4. Les frais d'arbitrage seront supportés à parts égales par les Parties contractantes. Article 16 Les droits imposés par l'une des Parties contractantes pour l'utilisation des aéroports et autres installations d'aviation par les aéronefs de l'entreprise désignée de l'autre Partie contractante ne seront pas plus élevés que ceux qui seraient imposés aux aéronefs nationaux qui exploiteraient des services aériens internationaux.

Article 17 Le présent Accord, toute modification de celui-ci et tout échange de notes diplomatiques en vertu du présent Accord seront enregistrés à l'Organisation de l'Aviation civile internationale.

Article 18 Le présent Accord abroge et remplace tous accords antérieurs sur les services aériens internationaux entre les Parties contractantes.

Article 19 1. Le présent Accord entrera en vigueur à la date de réception par le Gouvernement du Royaume de Belgique de la notification officielle de sa publication au Journal Officiel (Official Gazette) de la République de Chypre.2. Le Gouvernement du Royaume de Belgique informera le Gouvernement de la République de Chypre de la ratification du présent Accord par le Royaume de Belgique et le Gouvernement de la République de Chypre considérera le présent Accord comme réalisé, à la date de cette notification.3. En foi de quoi, les soussignés, dûment autorisés par leurs Gouvernements respectifs, ont signé le présent Accord. Fait en double exemplaire, en langue anglaise, à Nicosie, ce 8 juin 1963.

Annexe (2) Routes qui seront exploitées dans les deux sens par l'entreprise chypriote désignée : de Nicosie à Bruxelles via Istanbul et/ou un point en Yougoslavie et/ou Vienne et/ou un point en République fédérale d'Allemagne et/ou un point en Suisse et au-delà : a) jusqu'à Londres et/ou Amsterdam et/ou Stockholm et/ou New-York.b) jusqu'à Manchester et/ou Glasgow. L'entreprise chypriote désignée pourra, pour tous les vols ou pour certains d'entre eux, omettre de faire escale à l'un des points visés ci-dessus, pourvu que les services convenus sur la route commencent à Nicosie.

L'entreprise chypriote désignée pourra, pour tous les vols ou pour certains d'entre eux, faire escale à des points non mentionnés ci-dessus. En ce cas, elle ne pourra embarquer ni débarquer le trafic en passagers, marchandises et courrier provenant de ces points et à destination de Bruxelles ou vice versa.

II Routes qui seront exploitées dans les deux sens par l'entreprise belge désignée : de Bruxelles à Nicosie via Vienne et au-delà : a) jusqu'à des points en Iran, en Afghanistan, jusqu'à Karachi, Bombay, Colombo, Bangkok, Kuala Lumpur, Singapour, Djakarta, Manille, un point en Chine, Tokyo.b) jusqu'à Entebbe, Dar-Es-Salaam, Kigali, Bujumbura, un point au Zaïre, Lusaka, Johannesburg. L'entreprise belge désignée pourra, pour tous les vols ou pour certains d'entre eux, omettre de faire escale à l'un des points visés ci-dessus, pourvu que les services convenus sur la route commencent à Bruxelles.

L'entreprise belge désignée pourra, pour tous les vols ou pour certains d'entre eux, faire escale à des points non mentionnés ci-dessus. En ce cas, elle ne pourra embarquer ni débarquer le trafic en passagers, marchandises et courrier provenant de ces points et à destination de Nicosie ou vice versa. _______ Notes (1) Le présent Accord est entré en vigueur le 16 juin 1966, conformément aux dispositions de l'article 19.
